In an effort to cover-up the issue, in 2015, the Ms. Brisnehan and the CDPHE attempted to silence FACTs by issuing a "notice of violations" and a large fine, falsely claiming that FACTs had violated State regulations.
As part of their demands, the CDPHE stated they would drop the false allegations against FACTs if we permanently closed our doors for business, and our Senior Industrial Hygienist never practiced Industrial Hygiene again anywhere in the US and Mr. Connell would have to agree to leave every professional organization to which he belonged, and promise to never participate in any such organizations again. FACTs rejected the deal and filed suit against the State of Colorado.
The CDPHE fought desperately to keep the issue out of court claiming governmental immunity. They lost their battle and after a long and arduous legal struggle, in 2018 we finally were able to take the issue to trial.
In 2019, we won at trial, and in the process Ms. Brisnehan and Ms. Kelly were both caught lying on the stand under oath and attempting to introduce other falsified documents as evidence. The trial court rejected all of the CDPHE's claims against FACTs. The trial judge ruled that the CDPHE and Ms. Brisnehan and her office had abused its authority and the courts criticized Ms. Brisnehan as being duplicitous and unqualified to pass judgment on the professional services of FACTs. In fact, in the same 40 page ruling, on 14 separate locations, the courts favorably complimented FACTs and Mr. Connell for honesty and technical competency.
The CDPHE immediately appealed the trial decision to their internal legal team who rejected their appeal.
The CDPHE then filed an appeal in Colorado District Court who, in August of 2021, again slammed CDPHE and called the actions of Ms. Brisnehan and the CDPHE "capricious and arbitrary." The courts resoundingly rejected the CDPHE appeal.
On August 29, 2021, we have learned that although we keep winning battles, the CDPHE continues the war, and they have now filed yet another desperate appeal to squash the devastating ruling by the courts.
At this point none of us know if the Supreme Court or the Appellate Court will hear the case. We should know early 2022 which court will be involved. We believe we may then have (another) decision within about 18 months.
In the meantime, Ms. Brisnehan and the CDPHE are in contempt of court, and none of the thousands of regulatory violations incurred by fraudulent consultants are being addressed, and hundreds of Colorado Homes have now been impacted with falsified assessment reports. In spite of the devastating court rulings against Ms. Brisnehan and her office, she remains in charge of the program, and she continues to help untrained consultants falsify reports.

Furthermore, some home sellers are now discovering that the property they are trying to sell, and for which they have a "certificate of compliance" remain contaminated properties and the "certificate of compliance" is invalid, and the work was done by the consultant with the intent to defraud.
Finally, some home sellers are realizing they erroneously believed that since they held a falsified "certificate of compliance" they did not have to disclose the contaminated nature of the property. Now, they are discovering they have run afoul of the Real Estate disclosure laws by not disclosing the nature of the property.
How has this come about? After all, didn't the State of Colorado recently pass new legislation to prevent this from occurring?
Indeed, the State of Colorado did pass such legislation intended to stop the rampant problem of untrained and unauthorized consultants from performing fraudulent assessments of illegal drug laboratories. Many of the fraudulent consultants belonged to an organization called the "Colorado Association of Meth and Mold Professionals" (CAMMP).
CAMMP was a group of untrained consultants who were dabbling, without any known training in consultations regarding methamphetamine and indoor related mould (mold) issues. Many of these individuals would wake up one day and simply declare themselves "Industrial Hygienists" and decide they were qualified to perform the work of an Industrial Hygienist.
When they decided to do work involving illegal drug laboratories, they ran into a snag -Colorado Regulations 6 CCR 1014-3: Regulations Pertaining to the Cleanup of Methamphetamine Laboratories (effective March 30, 2005). These were some of the finest, science-based regulations in the country - regulations which prevented these consultants from performing work in illegal drug laboratories.
However, the consultants continued to perform illegal and invalid assessments, and falsified the real estate records with impunity. How could that be? Very simple - the members of CAMMP had a secret weapon in the Hazardous Materials and Waste Management Division of the Colorado Department Of Public Health and Environment (CDPHE), Ms. Colleen Brisnehan.
It turns out that Ms. Brisnehan was simultaneously serving on the Board of Directors for CAMMP. If someone challenged the legality or validity of an illegal assessment performed by a CAMMP member, Ms. Brisnehan, would personally use the full weight of the CDPHE would wade into the issue. And without revealing that she served on the Board of Directors, Ms. Brisnehan would lie, and with the intent to commit fraud and illegally obtain a benefit for her membership, and to maliciously cause harm to the challenger, Ms. Brisnehan would cover up the illegal assessment.
Eventually the situation became out of control as hundreds of illegal assessments were being discovered, and the CDPHE refused to reign in their reckless employees. Senator Tochtrop decided it was time to put a stop to the problem and passed SB 13-219 . This Senate Bill was designed to put an end to untrained consultants and illegal assessments.
In their infinite wisdom, the CDPHE, selected the one person in the CDPHE who had created the problem in the first place, Ms. Brisnehan, and put her in charge of the new regulations. One of Ms. Brisnehan's first official acts was to illegally grant instant "interim authorization" as personal favors to her membership, and to take administrative actions against anyone who opposed her in the past.
For this reason, hundreds more contaminated homes and residences of all kinds, and are now being falsely certified as "clean" and Ms. Brisnehan is, with the intent to defraud, and with the intent to obtain an illegal benefit for her friends, now having to dig deeper and deeper into the hole of corruption and is fabricating from whole cloth, falsified documents related to real estate transactions in attempt to cover her path. If a property owner has a property that was assessed after June 2015, there is a virtual guarantee the certificate of compliance is invalid, and the property remains a contaminated illegal drug laboratory.
As it turns out, the Board of Directors of CAMMP also included members of the Tri-County Health Department (TCH) who realized that if they did not jump on the corruption bus, it would run them over. As a result, members of the TCH willingly and knowingly, with the intent to defraud and with the intent to illegal obtain a benefit for themselves, and others, engaged in the fabrication and falsification of documents related to Real Estate transactions.
Legal Challenge
Ms. Brisnehan was also required by regulations to explain to any consultant not receiving a certificate the reason for the action. Ms. Brisnehan ignored the regulations and offered no explanation as to why she did not grant Forensic Applications the certificate as required.
Eventually, forced to respond, Ms. Brisnehan falsely claimed that FACTs had violated the State regulations, and that was why did not grant the certificate as required. However, since Ms. Brisnehan was unable to locate any actual violations, she merely invented "violations" that otherwise did not exist.
In November, 2018, after the State desperately tried to keep the issue out of the courts, the matter went to trial.
During the trial, both Colleen Brisnehan and Dianne Kelly (with the Tri-County Health Department) committed perjury under oath.
The trial Judge issued her ruling on January 15, 2019, (although the State withheld the ruling and refused to release the judge's findings until ten days later).
Amongst other things, the judge ruled that Ms. Brisnehan and the CDPHE had abused their Regulatory discretion by denying FACTs its license as required and the court refused to affirm the accusations claimed by Ms. Brisnehan, and Ms. Kelly with Tri-County Health. The judge ordered our license to be returned (which still has not been done).
Similarly, regarding Ms. Brisnehan, the Court ruled that
Ms. Kelly was then provided with a copy of the report in question, and asked to point out and identify for the judge the some of the various regulatory violations that she claimed required her to reject the report (and required the work to be re-done by another, favored, consultant, at the doubled expense of our client). After several minutes of pretending to look through the reports for the violations Ms. Kelly claimed were there, Ms. Kelly finally admitted under oath, that, in fact, she could not identify so much as a single regulatory violation in our work; she had simply lied under oath, and had been lying for years to the citizens of Tri-County.
The court found:
In an effort to prevent Forensic Applications from performing further work in the field, Ms. Brisnehan, without explanation, and without following the State regulations, refused to grant FACTs a State certification as she was required to do.
The ALJ finds Mr. Connell's professional judgment, based upon his assessment of the many a variables in the given circumstances more credible than Ms. Brisnehan's in these instances. Ms. Brisnehan is not qualified to be an Industrial Hygienist and was not present to do a personal assessment of the properties for which Mr. Connell conducted his reports.
During the trial, the State called Ms. Deanne Kelly with the Tri-County Health as one of their witnesses. Under oath, Ms. Kelly knowingly and intentionally lied to the court. During her testimony, she initially testified that she had rejected FACTs reports (for example, a report prepared for 9721 Josephine Street in Thornton) claiming the FACTs report contained numerous, serious, regulatory violations.
At hearing, Ms. Kelly reviewed the regulations and was unable to identify the rule that was the basis for her understanding that samples could not be contiguous to each other.

The current owner, through their legal counsel, Ms. Cinthia M. Manzano, is falsely claiming they have a letter from the City and County of Denver "explaining the property has received clearance." However, the attorney in question, who pretends to be an expert in meth-labs, has an history of making false statements, and the referenced letter from Denver specifically states the letter is not a certification of any kind, and is merely the acknowledgement of the receipt of a report that falsely claimsto be a clearance; the proffered report is an invalid and unlawfully performed "Preliminary Assessment." As of this date (May 26, 2016), there is no documentation that any lawful assessment, cleaning or clearance has ever been performed at the property.
The table below represents a very small portion of documentation of known illegal drug laboratories (meth-labs), and drug-lab related Public Domain documents in Colorado for which FACTs has firsthand knowledge. The far right column of the table identifies the known compliance status or resolution for that property. Where the property compliance resolution is "No," the property is not in compliance and occupancy in the residence is prohibited by statute. Where the property compliance resolution is "Yes," the property is completely compliant and is as safe as any other unaffected structure. Blue links in the table lead to Public Domain Documents. Compliant properties can be removed from the list by submitting the closeout documentation to FACTs.
